Acceptance of Terms
By downloading or using Feoh ("the App"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App. These terms may be updated from time to time; continued use of the App after any changes constitutes your acceptance of the revised terms.
App Store & Apple
This agreement is between you and the developer of Feoh only, and not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance, support, or warranty coverage for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price of the App to you; beyond that, Apple has no warranty obligation with respect to the App. Apple is not responsible for addressing any claims you or any third party may have relating to the App or your use of it, including product liability claims, consumer protection claims, or intellectual property infringement claims. You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
License
Subject to your compliance with these Terms, the developer grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, reverse engineer, or attempt to extract the source code of the App.
Intellectual Property
The App and all of its original content — including but not limited to its code, design, interface, and original visual assets — are and remain the exclusive property of the developer. Nothing in these Terms transfers any ownership of the App to you. Your right to use the App is limited to the licence granted above.
In-App Purchases
Unlock. The App offers a one-time, non-consumable in-app purchase ("Unlock"). Payment is processed by Apple through the App Store; the developer does not handle or store any payment information.
Family Sharing. The Unlock purchase supports Apple Family Sharing. One purchase covers all members of your Family Sharing group at no additional cost.
Tips. The App offers optional consumable tip purchases. These are voluntary payments to support development and grant no additional functionality. Tips are non-refundable once processed.
Refunds. All purchases are subject to Apple's standard refund policy. Refund requests must be directed to Apple via reportaproblem.apple.com. The developer has no ability to issue refunds directly.
Price changes. The developer reserves the right to change purchase prices at any time. Changes will not affect purchases already completed.
No Affiliation or Endorsement
Feoh is an independent, privately developed application. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Coles Group Limited, Woolworths Group Limited, The Card Network (TCN), Visa Inc., Mastercard International Incorporated, or any other brand, retailer, issuer, or payment network whose name, logo, or card artwork may appear in the App. All such names and marks are used solely for the purpose of identifying and organising gift cards belonging to the user.
Trademarks & Brand Names
All trademarks, service marks, trade names, logos, and brand identities referenced or displayed in the App — including but not limited to Coles, Woolworths, Visa, and Mastercard — are the property of their respective owners. Their appearance in the App does not imply any affiliation with or endorsement by those owners. Use of these marks is strictly referential and is intended solely to help users identify their own cards.
Fair Use of Brand Imagery
Certain card artwork, colour schemes, and visual identifiers associated with third-party brands may be reproduced within the App for the sole purpose of helping users recognise and distinguish their own gift cards. This use is intended to qualify as fair use / fair dealing under applicable copyright law, as it is transformative and limited to identification purposes. User-Provided Data
All card information you enter — including card numbers, PINs, balances, transaction history, notes, and expiry dates — is provided solely by you. You are responsible for the accuracy and completeness of the data you store. The App makes no representation that any balance, expiry date, or other card detail is current or correct. Always verify card details directly with the issuing retailer or network.
iCloud Sync
If you enable iCloud Sync, your card data is synchronised across your devices via Apple's CloudKit service using your personal iCloud account. The developer does not have access to your iCloud data. iCloud Sync is subject to Apple's iCloud Terms and Conditions and your available iCloud storage. The developer accepts no liability for sync failures, data conflicts, or data loss resulting from iCloud service interruptions or account issues.
Backup & Restore
The App provides an optional Backup & Restore feature that creates an encrypted file containing your card data. This file is stored on your device or wherever you choose to save it.
You are solely responsible for the safekeeping of your backup files. The developer accepts no responsibility for data loss resulting from failure to back up, accidental deletion of backup files, forgotten backup passphrases, or the inability to restore from a backup.
Balance Checking
The App may provide links to third-party retailer websites for the purpose of checking gift card balances. These links open external websites in an in-app browser. The App does not communicate with, query, or scrape any retailer website or external service on your behalf — all balance information within the App reflects only what you have manually entered. Third-party websites are subject to their own terms of use and privacy policies, and the developer accepts no responsibility for their content, accuracy, or availability.
No Financial Advice
The App is a personal organisational tool only. Nothing in the App constitutes financial, legal, or consumer advice. The developer is not a financial services provider and the App is not a regulated financial product. Balance information displayed in the App reflects only what you have manually entered and is not a real-time or verified account balance.
Security
Optional Face ID / Touch ID / passcode locking is provided as a convenience feature using Apple's LocalAuthentication framework. While this adds a layer of protection, you are responsible for maintaining the physical security of your device. The developer accepts no liability for unauthorised access to card information resulting from device compromise, lost or stolen devices, or circumvention of device security.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant that the App will be error-free, uninterrupted, or free of bugs or viruses.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
Limitation of Liability
To the fullest extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App — including but not limited to loss of gift card value, loss of card data, iCloud sync failures, inability to restore from a backup, or reliance on information displayed by the App. Your sole remedy for dissatisfaction with the App is to stop using it.
Nothing in this section limits any liability that cannot be excluded under the Australian Consumer Law.
Third-Party Services
The App integrates with or relies on the following third-party services, each governed by their own terms and privacy policies:
- Apple App Store / StoreKit — in-app purchase processing
- Apple CloudKit / iCloud — optional data synchronisation
- Apple LocalAuthentication — optional biometric locking
The developer has no control over and accepts no responsibility for these services.
Termination
The developer reserves the right to terminate or suspend your licence to use the App at any time if you breach these Terms. Upon termination, you must cease all use of the App. Termination does not affect any data stored on your device.
Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force and effect.
Governing Law
These Terms of Use are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from the use of the App shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
